Contingency Collection Agency Rates and Contingency Debt Collection Costs
A contingency collection agency charges nothing up front and keeps 20% to 50% of whatever it recovers. That is a fair deal on a customer who has gone silent. On an invoice that is simply late, it is a quarter of the money for work you can start today for a flat fee.
Flat monthly fee from $49. You stay the creditor and keep 100% of every payment.
A contingency collection agency is paid only when it collects, usually 20% to 35% of the recovered amount on US business debts and up to 50% on small or old claims. On a $10,000 invoice that is $2,000 to $3,575 at the published rates of Kaplan, STA International, Creditors Adjustment Bureau and IC System. Place a file with an agency when the customer has stopped answering. For invoices under about 120 days late where the customer still talks to you, a flat fee collections sequence at $49 a month recovers the same money without the cut.
Six things that decide what a contingency agency costs you
The headline percentage is only one line of a placement agreement. These are the terms that move the effective rate, and every one of them should be in writing before you sign.
Tiers by claim size
Most commercial agencies charge more on small claims because the work per file is the same. Kaplan runs 25% on claims of $3,000 to $9,999 and steps down to 20%, 15% and 10% as the claim grows. Creditors Adjustment Bureau takes 50% of the first $500.
Tiers by age
Older debts collect less often, so the rate rises. Creditors Adjustment Bureau moves any claim over a year old to 50%. Industry guides put accounts under 90 days at 25% to 35% and accounts over a year at 40% to 50%.
Minimum claim size
A contingency agency needs a fee big enough to cover its collectors. STA International takes commercial claims of $2,500 and above. Kaplan expects new clients to place an average claim above $5,000. Below that, many files are simply declined.
Payments made directly to you
Most placement agreements still pay the agency its percentage if the customer pays you directly after the file is placed. Creditors Adjustment Bureau states it in its terms. This clause alone can cost more than the difference between two headline rates.
Withdrawal and cancellation
Pull a file because the customer called you to settle and many agreements still charge the commission, or a withdrawal fee. Ask what happens if you close the account yourself in week two.
Suit and attorney forwarding
When a file goes to suit the contingency usually rises to 30% to 50%, and court costs are advanced by you. Kaplan quotes 30% to 35% including the attorney, plus an initial cost advance from $1,300.
How to decide between a contingency agency and a flat fee sequence
Run this on your aging report today. It takes ten minutes and it usually splits your overdue list into two short piles.
-
Step 1
Sort by days past due
Pull every open invoice over 30 days. Anything under about 120 days where the customer still replies to email belongs in a written sequence, not with an agency.
-
Step 2
Load the early pile into DebtAgent
Import the customers, invoice numbers, amounts and due dates. The agent drafts a friendly, firm and final email sequence in your own name, and you approve it once.
-
Step 3
Let the sequence run
Messages go out on schedule until the customer pays or commits to a date. Payments go straight to you, so there is no commission and nothing to reconcile with a third party.
-
Step 4
Place only the silent files
When a customer ignores the final notice, place that one file with a contingency agency that publishes its rate card. You now pay the percentage only on the accounts that truly need it.
What a contingency collection agency charges on a $3,000 and a $10,000 invoice
Figures are each agency's own published rates, read at source in September 2026. Where an agency does not publish a rate, the table says so rather than guessing.
| Provider | Published rate | Fee on $3,000 collected | Fee on $10,000 collected |
|---|---|---|---|
| DebtAgent (software, not an agency) | $49 a month flat, Starter | $49 to $147 (one to three months) | $49 to $147 (one to three months) |
| Kaplan Group | 25% on $3,000 to $9,999, 20% on $10,000 to $49,999 | $750 | $2,000 |
| STA International | 25% on the first $5,000, 20% on the balance, $2,500 minimum | $750 | $2,250 |
| Creditors Adjustment Bureau | 50% of the first $500, 20% of the balance | $750 | $2,150 |
| IC System InstiCollect | 35% of recoveries plus a one time $75 setup fee | $1,125 | $3,575 |
| Summit A•R | 7.5% to 50%, no minimums, breakpoints not published | $225 to $1,500 | $750 to $5,000 |
| Empire Credit and Collection | No rate published, offers to match competitor rates | Quote only | Quote only |
Contingency fees apply only to money actually collected. None of these figures include suit, court costs or the commission most agencies earn when a customer pays you directly after placement.
What percentage do collection agencies take?
Most US collection agencies take 20% to 35% of what they recover on business debts, and 40% to 50% on claims that are small, more than a year old, or already worked by someone else. The published cards cluster tightly: Kaplan charges 25% on claims of $3,000 to $9,999, STA International 25% on the first $5,000, IC System 35% through its small business program. One of the lowest published percentage cards is Atradius Collections at 18.5% on US claims over $2,500.
The percentage you actually pay depends on three things, in this order: the age of the debt when you place it, the size of the claim, and how many accounts you send. A business that places a steady volume of fresh claims negotiates the low end. A business that sends one old invoice pays the top. For a full breakdown of every published card, see collection agency fees and rates.
Is a contingency collection agency worth it for a small business?
It is worth it on a customer who has stopped answering you and owes more than about $2,500. At that point the agency's letterhead, skip tracing and the credible threat of suit do something your own emails can no longer do, and paying 20% to 25% of money you would otherwise lose is a good trade.
It is not worth it on invoices that are simply late. Most B2B invoices under 90 days get paid after a firm, dated written demand, and sending that demand is not worth a quarter of the invoice. It is also not worth it below the agency's minimum, because the file is usually declined rather than repriced. The honest split is early files in a flat fee debt collection sequence, silent files with an agency. Our guide to the best collection agency for small business ranks the agencies that publish their rates by fee and minimum claim.
How does no collection, no fee debt collection work?
No collection, no fee is another name for contingency pricing: the agency charges nothing to open the file and is paid a percentage only from what it recovers. If nothing is collected, you owe nothing, apart from any costs you agreed to advance.
Three details decide whether it is really free. First, the direct payment clause: if the customer pays you instead of the agency, most contracts still owe the commission. Second, setup or file fees, such as the $75 IC System charges on its InstiCollect program. Third, suit: once a file is forwarded to an attorney, court costs are usually advanced by you and the rate rises. Read those three clauses before you sign anything labeled no collection, no fee.
Contingency vs flat fee collection agency, which delivers better returns?
On claims your customer will pay once pressed, a flat fee delivers better returns because the cost does not grow with the invoice. On a batch of ten $5,000 invoices that pay within 90 days, contingency at 25% costs $12,500. A DebtAgent Plus plan covering 250 active debtors costs $149 a month, or $447 over three months.
On claims your customer will not pay without outside pressure, contingency wins, because a flat fee sender that stops at email will not move them and an agency with skip tracing and attorney forwarding might. Per account flat fee agencies sit in between: they charge a small fixed amount at placement, typically $10 to $25 per account, for a short letter and call program. Most CFOs end up using both routes, split by the age of the file. Our debt collection software pricing comparison shows how 17 tools charge.
Do debt collection attorneys work on contingency?
Many commercial collection attorneys do, usually at 30% to 50% of what they recover, and almost all of them ask you to advance court costs and filing fees. Kaplan Group's litigation cost page quotes 30% to 35% including the attorney, an initial cost advance from $1,300, and a non contingent fee of $1,000 to $2,500 or 5% of the claim in most cases.
That makes suit a tool for claims large enough to absorb those costs against a debtor who has assets and no real dispute. For invoices under about $30,000 it is usually cheaper to run a firm written sequence first. Our page on commercial collections attorney costs works the numbers on real claim sizes, and recovering unpaid invoices without legal fees covers the routes before suit.
Contingency collection agency questions
What is a contingency collection agency?
A contingency collection agency is a third party collector that charges nothing up front and is paid a percentage of whatever it recovers, typically 20% to 50%. If it collects nothing, you owe no commission. Most commercial agencies in the US work this way, with rates tiered by claim size and age.
How much do contingency collection agencies charge?
Published US commercial rates run from about 20% to 35% on typical claims and up to 50% on small, old or previously worked debts. Kaplan charges 25% on $3,000 to $9,999, STA International 25% on the first $5,000, and IC System 35% plus a $75 setup fee on its small business program.
What is the minimum claim a contingency agency will take?
Many commercial agencies set a floor near $2,500 to $5,000. STA International takes claims of $2,500 and above, and Kaplan expects new clients to place an average claim above $5,000. Below those levels files are often declined, so a flat fee sequence is the practical route.
Do I still owe the agency if my customer pays me directly?
Usually yes. Most placement agreements earn the agency its percentage on any payment made after the file is placed, even if the customer sends it to you. Creditors Adjustment Bureau states this in its published terms. Check the direct payment clause before you place a file.
When should I send an invoice to a contingency collection agency?
Place a file once the customer has ignored a final written notice and the invoice is roughly 90 to 120 days past due. Before that, a firm dated email sequence in your own name recovers most B2B invoices without paying a commission.
Is DebtAgent a contingency collection agency?
No. DebtAgent is collections software on a flat monthly fee from $49. It sends the email sequence in your company's name, payments go straight to you, and it takes no percentage. It does not sue, skip trace or report to credit bureaus, so silent files still belong with an agency.
You are handing us your customers' names. Here is what happens to them.
Collections data is unusually sensitive, so we treat it that way: TLS in transit, encrypted storage, a full compliance audit log, and debtor records that are never used to train public models. Card details go to our payment processor and never touch us. Account deletion means delete, everywhere. We are also honest about where we are not yet: no SOC 2 report yet, no SSO yet, no invented customer logos or testimonials either.
Chase the early files before you pay anyone a percentage
Load one real overdue invoice and the agent drafts the full friendly, firm and final sequence in your name. Approve it once and it runs until the customer pays. Place only the files that go silent.
